JURY ISSUES LARGEST MEDICAL MALPRACTICE AWARD IN WICOMICO COUNTY HISTORY
Salisbury, Maryland - A jury ruled last week that Dr. Peter Libby and Peninsula Radiology Associates, PA, are to pay Mary and Tim Raver of Selbyville, Delaware, $3.38 million due to Dr. Libby's failure to correctly identify and interpret abnormalities in Mary Raver's CT scan. This misstep allowed Ms. Raver's cancer to progress from a curable stage I to a terminal stage IV.
The considerable $3.38 million award is the biggest in Wicomico County's history for a medical malpractice case. Lead counsel Damien R. Banks of The Banks Firm, LLC, his associate Megan A. Cahill, and local counsel John K. Phoebus of Anthenelli, Phoebus & Hickman represented the Raver family throughout the process. "The jury meticulously reviewed the evidence and came to a just conclusion," said Mr. Banks. He added, "Mrs. Raver has endured so much. She still has a monumental battle ahead but we're delighted that she can now focus her attention on enjoying the time remaining with Mr. Raver."

The jury awarded $1.2 million in non-economic damages and $2,185,317.75 in economic damages, the latter including past and future medical costs, lost household services, and diminished earning ability.
